Q. What is the City of Foley's sales tax rate?
A. The total amount of sales tax in the corporate city limits of Foley is 9%(4% to the state, 3% to Baldwin in County and 2% to the City of Foley). In the police jurisdiction, the rate is 8%(4% to the state, 3% to Baldwin County and 1% to the City). Q. Who collects the City of Foley's sales tax ?

Q. Do I need a City of Foley business license ?
A If you make deliveries, perform services, have sales people calling on local merchants, or have a store or office located in the City of Foley or its police jurisdiction, you need a City of Foley business license. Q. Who handles the commercial trash service in Foley ?
A. For businesses in the corporate city limits only, commercial trash dumpsters are provided through the City of Foley. Contact Meg Hellmich or Daisha Barnes for specific information. Q. Does the City of Foley collect Liquor Tax?
A. Yes. The liquor tax rate is 10% of all purchases from the ABC Store or 5% in the (fire) jurisdiction. You may download a form under the "Applications/Forms" section of our website.
Business Located within the Corporate City Limits of Foley
Q. My business will be serving alcohol, beer and/or wine, and my business is located within the Corporate City Limits of Foley, what is the process to obtain a City of Foley license?
A. All businesses that intend to sell beer, wine or liquor must have prior approval from the Mayor and Council or County Commission, dependent upon location. Steps are as follows:
Step 1: Apply for a license to sell alcohol, beer or wine at the ABC Board. Contact information for ABC Board is: (251)947-2971.
Step 2: Once the ABC Board completes your application, they will fax a copy to the City of Foley. Once we receive the application, we will add the request to our next scheduled Council Meeting (see Council Agendas and Minutes for details regarding dates for submitting items).
Step 3: After the Mayor and Council approve your request, a letter will be faxed directly to the ABC Board confirming the approval. You will now need to obtain a City of Foley business license.
Business Located within the Police (Fire) Jurisdiction of Foley
Q. My business will be serving alcohol, beer and/or wine, and my business is not in the Corporate City Limits of Foley but it is in the Police Jurisdiction of Foley, what is the process to obtain a City of Foley license ?
A. All businesses, located within the Police Jurisdiction, that intend to sell beer, wine or liquor must have prior approval from County Commission. Steps are as follows:
Step 1: Apply for a license to sell alcohol, beer or wine at the ABC Board. Contact information for ABC Board is: (251)947-2971.
Step 2: Contact the Baldwin County Commission office at (251)943-5061 to schedule Public Hearing for approval of your request to sell liquor, beer or wine.
Step 3: After the County Commission approves your request, submit a copy of the approval to the Revenue Department. You will need to obtain a City of Foley business license. License fees are 1/2 of the normal fee for businesses located in the police (fire) jurisdiction.
Please note all businesses physically located within the Corporate City Limits of Foley will need to complete the Business License Pre-Approval Form.

PLEASE NOTE THAT THIS REQUIREMENT IS FOR BOTH THE ISSUANCE OF NEW BUSINESS LICENSES AND 2012 RENEWALS.
Act 2011-535, commonly referred to as the Immigration Law, became effective on September 28, 2011. Section 30 of this Act states that a person conducting a business transaction must prove that he or she is a citizen of the United States or is an alien with a lawful presence in the U.S. before entering into a business transaction with the State or a political subdivision of the State.
Business transactions include (but are not limited to): Purchasing or renewing business licenses (Corporations, LLC’s and LLP’s are exempt from this requirement, upon presentation of the incorporation documents).
All registered co-owners must present proof of citizenship or lawful presence. Please be aware that Act 2011-535 establishes criminal penalties for entering into a “business transaction” on behalf of an illegal alien.
In order for the City of Foley to fully comply with this law, we are now required to request proof of citizenship by obtaining one of the documents shown below (legible copies, faxes and scanned documents sent via e-mail are acceptable):
1. A driver’s license or non-driver identification card issued by the Alabama Department of Public Safety (an Alabama driver’s license or non-driver ID card). A driver’s license issued by another jurisdiction will only be acceptable if there is language printed on the license or identification card, by the issuing jurisdiction, that indicates that the person has provided satisfactory proof of United States citizenship. All driver’s licenses and non-driver’s identification cards must be valid (unexpired).
2. U. S. birth certificate
3. U.S. issued valid or expired passport identifying the applicant and the applicant’s passport number
4. Naturalization documents or the number of the certificate of naturalization (number must be verified with the U.S. Bureau of Citizenship and Immigration Services by the City)
5. Proof issued by the federal government pursuant to the Immigration and Nationality Act of 1952
6. Bureau of Indian Affairs card number, tribal treaty card number or tribal enrollment number
7. Consular report of birth abroad of a citizen of the U.S.
8. Certificate of citizenship issued by U.S. Citizenship and Immigration Services
9. Certification of report of birth issued by the U.S. Department of State
10. American Indian card, with KIC classification, issued by the U.S. Department of Homeland Security
11. Final adoption decree showing the applicant’s name and U.S. birthplace
12. Official U.S. military record of service with the applicant’s place of birth in the U.S (a U.S. military ID card, however, is not acceptable)
13. An extract from a U.S. hospital record of birth created at the time of the applicant’s birth indicating the applicant’s place of birth in the U.S.
If you are an alien with a lawful presence, one of the documents shown below must be presented for verification each year:
1. A valid, unexpired Alabama driver’s license or non-driver ID card
2. A valid tribal enrollment card or other form of tribal identification bearing a photograph or other biometric identifier
3. Any valid United States federal or state government issued identification document bearing a photograph or other biometric identifier, if issued by an entity that requires proof of lawful presence in the U.S before issuance
4. A foreign passport with an unexpired U.S Visa and a corresponding stamp or notation by the U.S. Department of Homeland Security indicating the bearer’s admission to the U.S.
5. A foreign passport issued by a visa waiver country with the corresponding entry stamp and unexpired duration of stay annotation or an I-94 form issued by the U.S. Department of Homeland Security indicating the bearer’s admission to the U.S.
For example:
If you have a valid Alabama driver’s license or non-driver identification card, you may obtain a City of Foley business license. The City is required to verify your driver’s license information by utilizing the State of Alabama Driver License Verification website at https://alverify.mvtrip.alabama.gov. If your driver’s license does not verify, an additional document from the list will be required. If you wish, you may access this website yourself to ensure that your license is verifiable prior to submitting it for verification
If you were born in the United States and have a driver’s license or non-driver’s identification card issued by a state other than Alabama, unless the card specifies that proof of citizenship has been submitted, you must provide either a birth certificate or a passport. Please note that legible copies, faxes and scanned documents sent via e-mail are acceptable.
